A lawsuit filed by Smithfield Foods against the United Food and Commercial Workers will proceed to trial. UFCW had requested a federal court dismiss the suit which alleges they conducted a union-led public smear campaign against Smithfield. A federal court on Tuesday denied the UFCW’s motion to dismiss.

The ruling means Smithfield's civil suit, brought pursuant to the Racketeer Influenced and Corrupt Organizations (RICO) Act, is expected to proceed to trial. It also afforded the companies the opportunity to amend one of several counts to more closely track the provisions of the RICO law.

"The companies believe their ability to pursue the case is a pivotal step toward upholding the law, protecting the rights of Smithfield's workers and preventing further damage to Smithfield's business," the companies said in a news release.

Smithfield filed the lawsuit last October.
